Fuel Cells Win a Legal Victory in Santa Clara

Bloom Energy faced down a legal battle in Santa Clara, CA and have come out with a huge legal victory for fuel cells. Santa Clara pushed a city resolution to ban future installations of fuel cells in the city. Bloom Energy met them in court and the finding is in Bloom Energy's favor. 

The court found that the City had jumped the gun and issued the resolution without having done their due diligence. Their initial resolve to ban natural gas fuel cells was issued without performing any impact studies to show the public the effects of such resolutions. Therefore, the City was not only violating law the California Environmental Quality Act, but also caught up in possibly supporting other more environmentally unsafe energy sources. 

The court ruling affirmed that the actions of the City would result in increased greenhouse gas emissions and a higher reliance on other combustion based energy sources. Further documents showed that Policymakers in this case were either misguided, at best, or willfully ignoring the public safety, at worst. 

With the resolution now at rest, fuel cells look to have a brighter future in California.
